TERMS & CONDITIONS
PRIVACY & SAFETY

We are not in the business of selling personal information about our users to third parties.  We will not provide your personal information to any third parties for the purpose of direct marketing.  We may disclose information about our users to third-party service providers that assist us in our work.  We limit the personal information provided to these service providers to that which is reasonably necessary for them to perform their work for us

 

We may also disclose information about our users, including personal information, if we believe that doing so is legally required or is in our interest to protect our property or other legal rights (including, but not limited to, enforcement of our agreements), or the rights or property of others.

 

We use reasonable security measures that are designed to protect information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction.  Please note, however, that no data security measures can be guaranteed to be completely effective.  Consequently, we cannot ensure or warrant the security of any personal information or other information.  You transmit personal information to us at your own risk

ORDERING AND PAYMENT

To place your order, fill in the Order Form provided on our website or email us.  Orders are taken depending on availability.  We reserve the rights to reject any order.

Once you send in an order, please wait to hear from us or receive a confirmation email from us.  We usually reply to emails within 2 working days.

 

For Dessert Tables: At the Time of Booking, a 50% non-refundable deposit is required to secure the date for dessert tables or cakes (including rentals if applicable), with the remaining balance due 30 days before the event.  You are more than welcome to pay the full amount upfront.

If balance is not paid in full by the due date, the contract will become null and void, and no refund of any type will be applied. 

Payment can be made through valid credit card, cash, or personal check.  A $30 charge will apply to any returned check.  

 

Finalizing your order through settling the 50% non-refundable deposit confirms that you have thoroughly read and accept the Terms & Conditions.  Failure to read the Terms & Conditions will not exempt you from it.

CHANGES AND CANCELLATIONS

The only person to make changes or cancellations to said contract is the person signing the contract, and IN WRITING

Cancellations occurring more than 30 days before your event will result in a forfeit of your initial deposit.  Cancellations within 30 days of your event date, the full event fee must be paid (The credit card on file will be automatically charged).  Deposits are non-refundable & non-transferable.

Any exceptions will be considered on a case-by-case basis subject to our discretion.

VARIATIONS IN FINAL PRODUCTS

Because all of our goods are individually handmade, they may not always appear exactly as in photographs or descriptions.  Any illustrations on our site are published to provide you with an approximate idea of the goods.

ALLERGIES

As all Sweet and Divine Baking goods are produced in the same kitchen where nuts, gluten, and dairy are present, we cannot guarantee that our products are nut/gluten/dairy free.  However, we do try to make an effort to accommodate these allergies—please notify us when placing an order.

LIABILITY

Client agrees to assume full responsibility for any and all claims arising out of the use of the dessert table or its attendants.

 

Sweet and Divine Baking will not be liable for any injury, allergic reaction, loss or damage directly or consequently arising out of the use of anything that is included in the dessert table.  Client indemnifies Sweet and Divine Baking harmless from all claims, actions, proceedings, costs, damages and liability including attorney fees and court cost arising out in connections with or resulting from the services of Sweet and Divine Baking.

CONSUMPTION, CARE & STORAGE

All of Sweet and Divine Baking products are best kept in a cool environment at all times.  An area with air conditioning is best.  Avoid direct sun over the desserts. 

 

Fondant/gumpaste/pastillage and tiered cakes are supported by toothpicks/straws/dowels.  Please be sure to remove these before serving.

 

Sweet and Divine Baking takes pride in baking its desserts knowing exactly what goes into them and with no additives or preservatives.  We are, therefore, unable to make a warranty as to the length of time for which the desserts will remain fit for consumption.  We do, however, recommend our desserts to be eaten within 3 days from collection/delivery (Some should be kept chilled within those days).

 

This section serves as a guide for prolonged storage of your product.  Nonetheless, conditions may vary in different environments and this guide must thus be followed with care.  We highly recommend your order be consumed the day you receive it.  Be vigilant and exercise good judgement in storing and consuming products.

 

Packaging and Transportation: Our desserts and cakes are packaged safely in boxes.  As such, they should arrive to you in the same perfect condition that they leave us in.  If you pick up your order, once you take your order from us, it is yours to treasure.  Desserts don’t make any noise, so remember to drive carefully!

 

*Heat and humidity will cause product breakdown during outside receptions*

FORTUITOUS EVENTS

Sweet and Divine Baking is not responsible in cases of a fortuitous event on the side of Sweet and Divine Baking, natural disasters, and all other unsafe conditions that could cause a failure to complete and or deliver your order, or cause a cancellation of the event for which the order was made for.

 

Sweet and Divine Baking reserves the right to not be held liable for damages caused by such fortuitous events.  We will, however, always do our best to ensure that you receive the high quality of products and service you deserve.

COMPLAINTS & SUGGESTIONS

We take all complaints seriously.  If you experience any problem with our products, a written complaint (explaining in detail) must be made within 3 consecutive days of receipt.  Part or all of the parcel may have to be returned to investigate the complaint.  The maximum refund offered is the value of the desserts.  Further compensation is not available.

 

We understand that some things happen which are out of your control and we will work with you if you experience difficulty.  Communication is vital, so please contact us, we would love to work together.
